Board of Directors Chairman Issues Statement on FFT vs Optellios Litigation

Newtown, PA (August 18, 2010) - For immediate public release:

An Open Letter from Our Chairman

Dear Optellios customers, suppliers, distributors, and prospective employees,

Over the past few years you may have heard some disturbing rumors relating to litigation that Future Fibre Technologies (FFT) filed against Optellios. Let me share some facts.

On November 28, 2006 Optellios was awarded patent number US7142736, titled “Distributed fiber sensor with interference detection and polarization state management”. Despite the fact that prior to the issuance of this patent FFT had signed a broad settlement agreement that ended all earlier litigation with Optellios, and despite the fact that Optellios did not attempt to assert this patent against FFT, FFT brought suit claiming that only its employees are entitled to be named as inventors on this patent.

In response, Optellios countersued FFT for infringement of this patent.  If Optellios ultimately prevails in this matter, Optellios will seek monetary damages from FFT and may be entitled to obtain an injunction prohibiting FFT from infringing the patent.

Customers should know that Optellios is under new management. We thank our founder for his years of service and wish him well in his new endeavors.  Despite what you may have heard, Optellios is well financed and is headed for a record sales year. Customers should rest assured that we intend to vigorously defend ourselves in this litigation as well as assert our growing body of industry-leading intellectual property to the fullest extent permitted by the law.
